Terms and Conditions of Rental

DRIVING QUALIFICATION – Driver must be from 23 years to 75 Years old and it is necessary to present a valid driving license issued for at least, 1 year. Main driver must have credit Card (Not debit card, Virtual Card, pre-paid card) and with embossed numbers, in his name, with enough funds for the deposit/excess or other costs in the rental period.

SECURITY DEPOSIT – A security deposit is requested in the amount of the Excess (Currently from 1000€ to 2100€) depending on the car Group. Lower deposit may be possible depending on the extra insurances bought directly with Rodavante.

USE OF VEHICLE – Client/Driver acknowledges that he receives the vehicle with the necessary documents, Tools, spare tire or emergency kit and that all of it must be returned in good conditions. Client/Driver agrees to drive the said vehicle carefully in accordance with the regulations of local motor traffic code. He also undertakes:

a) Not allowing any person to drive the vehicle others than him self or the persons authorized in the rental agreement.

b) Not carrying passengers or goods or to use the vehicle in any kind of activity, when this implies subleasing the vehicle directly or indirectly. Also, not use the vehicle to provide services to third parties, whether paid or not.

c) Not to drive the said vehicle when physical condition is impaired by alcohol, drugs, fatigue or illness.

d) Not to propel or tow other vehicles or trailers.

e) Not to participate in races, or sport activities with the vehicle.

f) Not to carry more passengers, or weight than specified by the vehicle manufacturer or permitted by law.

g) To keep the vehicle properly parked and locked when not using it.

h) Not smoking or allow any passenger to smoke inside the vehicle.

i) Not to transport animals of any species.

Client/Driver acknowledges that vehicle can be taken away by rodavante in the progress of this rental if one or more, of the above conditions are not fulfill, resulting in no kind of reimbursement for unused period.

MAINTENANCE- RODAVANTE delivers the car in perfect running conditions, if a malfunction is detected it must be communicated, immediately to Rodavante. All Cars from Rodavante are perfectly capable vehicles in accordance with manufactures specifications. Rodavante will not assume any responsibility if vehicle do not match up with Client/Driver expectations due to performance, power or fuel consumption, that may vary due to the weight carried, local natural features or others. Important Note: If a malfunction on the clutch is noted in the first driven kms (less than 80 kms), it must be reported to Rodavante, because if clutch gets damaged during the rental period, it will be charged to costumer.

DELEVERIES AND DROP-OFFS – Delivery and drop-off of vehicle is free at our offices and hotels in their neighborhood, at office’s working hours. At the airports Rentals are charged as per current Rates folder. For deliveries after mid-night, rentals are also charged. Out of working hours drop-offs are also charged. This service is also available for other locations for an extra charge.

COST OF RENTAL – The full rental cost is calculated on the basis of the daily Rate and is payable in advance, on delivery of the car to the Client/Driver.

FUEL – The client must return the vehicle with the same amount of fuel as received. The value of the missing fuel will be charged, with a minimum value of €20.00.

For any excess fuel left in the vehicle, no refund will be given to the client.

CHANGE OF RENTAL – If Client/Driver wishes to prolong or shorten the Rental period, he must inform Rodavante, at least, with 24 hours advance, and get authorization therefore. When wishing to prolong, initial rate may change. For shortening the rental period – if authorized, any discounts or benefits initially given will be lost and rental recalculated at the highest Public Rate. Refunds may be not possible.

INSURANCE (LIABILITY) – Vehicle is insured for unlimited public liability risks (persons or goods). It is also insured with CDW that covers the following damages (although limited to an excess as per current rental rates):

1º) Damages due to impact or collision.

2º) Damages due to vandalism acts (By known or unknown persons), like broken locks, glasses, or any part of the car spoilt and or in consequence of a breaking attempt. Theft or loss of the vehicle (whole or parts of it) or Car keys.

3º) Damages on tires, rims, windows, glasses, headlights or similar lights, car Keys, Locks, vehicle underside, roof and car interior.

4º) Cost of transportation and/or towing the damaged car to our repair shop and immobilization (loss of use) of the rented car while repairing, when accidents are of Client/Drivers responsibility.

5º) Costs for repairing the car, when inappropriate Fuel is used, and loss of use while repairing.

6º) Costs for replacing clutch, burned when driving the rented vehicle more than 80 kms, without previously communicating any malfunction.

7º) Cost for assistance on the road for car breakdowns due to neglect, forget or loss (ie battery discharges), duplicate keys, change of tyres, etc.

The following damages are not covered by any Insurance and Client is FULLY responsible for:

1º) Any Damage, loss or theft of articles or goods transported, stored or left unattended in the rented vehicle regardless any circumstances.

2º) All Damages caused (to the rented car and others) while driving the car under the influence of alcohol, narcotics, drugs, toxic products.

3º) All Damages caused to the rented car due to carelessness, negligence, imprudence, abuse or disregard of basic security procedures or traffic warning signs.

4º) All Damages caused while participating in car Races or similar sportive events or in any other contests or preparing one.

5º) Cost for cleaning the interior (Carpets, seats, roof,…) including but not exclusive of strong odours, smoke smell, pet’s hair, sand, bodily fluids, unknown liquids, dirt, ink or sticky stains, or hardly removable dirt, mud, etc.

6º) Damages to car Keys, Locks, roof, seats or interior damage and vehicle underside (Engine, Suspension, Steering, Exhaust and Chassis) or any other area of the vehicle, damaged in consequence of impact with an horizontal obstacle (ie sidewalks, roadsides, fallen stones, objects or holes on the road).

IMPORTANT: Some damage may not be apparent at the post-rental inspection, such as mechanical damage (for example in areas such as the engine, underside, gear box or clutch) or damage hidden by adverse light or weather conditions. If we find any such damage, when refitting vehicle for new rental, we will notify you with evidence of the same.

OPTIONAL INSURANCES:

PAI – Passengers Insurance – Medical expenses or indemnity in consequence of body injuries.

TW – Theft Waiver – Coverage for theft or loss of the vehicle (Do not include damage due to breaking attempt, theft or loss of car parts – ie. antenna, wheels, etc – and car keys).

TCDW- Top CDW – Coverage (with no excess) for Damages on tires, rims, windows, glasses, mirrors, headlights or similar lights

SCDW-
Super CDW – Excess reduction or exemption, for damages in consequence of Collision, Crash or Impact on the bodywork , ie Scratches, Dents, Bumps , of the rented car .

ACCIDENTS: In case of accidents in which the car gets damage or causes damages, the Client/Driver undertakes to have the case immediately investigated on the spot by the local police authorities. Client/Driver can not leave from the place of the accident and/or abandon vehicle until police or Rodavante Representative is present.
He is further required to make a sketch of the place of accident, adding the names and addresses of the persons who have been a party to the accident, the names of witnesses, and any other pertinent details.
Client/Driver should avoid making any verbal of written promises.
In case of non compliance with these requests, Client/Driver is fully responsible for all damages and/or losses sustained in case of accident and/or damages to the rented car.

RENTER LIABILITY: RODAVANTE is not liable for any damage or loss which the Signer may sustain due to car defect or breakdown or by consequence of any mandatory requirement of the terms above, or time lost when picking up or dropping off the rented vehicle, should cause delay or prevent him from continuing the journey. RODAVANTE will not be responsible for any kind of other expanses if not previously authorized.

FINES: The Client/Driver is responsible for all fines that may occur during the rental period. In consequence, Driver’s Identification, address and contacts will be given to authorities when requested.

GUARANTEE: The Signer explicitly authorizes RODAVANTE to charge his Credit for expenses that may outcome from this Rental Terms, that will be communicated by email (Email address must be provided on Client contacts) with related documentation.

APPLICABLE LAW: Portuguese Law is applicable to this Rental agreement in case of disagreement which cannot be amicably settled the parties agree to submit the dispute to the jurisdiction of the court of law of Funchal. The Signer expressly agrees to abide by the decision of the courts of Law of Portugal.

CANCELLATION POLICY

The Client may cancel a reservation under the following terms:
a) If done up to 8 days before the rental starts, there will be no cost or penalty for the Client, who will be reimbursed the full amount of the advance payment (including extras, optional services, and coverage);

b) If done between 8 and 3 days before the rental starts, up to 3 days of rental (including extras, optional services, and coverage) will be charged, and the advance payment exceeding the 3 rental days will be reimbursed;

c) If done within 2 days before the rental starts, no refund will be provided.

d) In the event that the Client does not appear at the rental station on the date and time indicated in the reservation, the rental will be considered a “no-show”, and no refund of the advance payment will be provided.

e) An administrative fee of €3.90 will be charged, which will be deducted from the refund amount.
